Ascend Luxee Aviation

Terms & Conditions

Effective Date: May 18, 2026 | Comprehensive Charter Agreement

⚠️ Important Notice for Pilgrims

By confirming your booking with Ascend Luxee Aviation, you unconditionally accept the terms outlined below. Helicopter operations in high-altitude Himalayan terrain (Kedarnath & Badrinath sectors) are subject to unique regulatory, technical, and weather constraints. Please review these clauses thoroughly before completing your reservation.

1. Booking Contract & Payment Terms

All helicopter charter and package reservations are formal contracts between the passenger(s) and Ascend Luxee Aviation. A booking is only considered legally confirmed once the full invoice or the mutually agreed advance payment is successfully processed and a valid booking voucher is issued by our ticketing desk.

Prices are quoted based on current aviation tariffs, fuel costs, and government taxes. We reserve the right to adjust final pricing in the event of unexpected statutory hikes, inflation in airport handling fees, or fuel price fluctuations imposed by civil aviation authorities.

2. Strict Weight & Payload Guidelines

Helicopter operations have absolute structural weight limitations dictated by aircraft safety protocols and high-altitude aerodynamic requirements.

Standard Compliance

  • Maximum standard weight limit is 75 kg per passenger.
  • Passengers must provide exact, real weights at the time of booking.
  • Body weights will be cross-verified on scale before boarding at the helipad.

Overweight Regulations

  • Weight exceeding 75 kg attracts an extra charge of INR 1,000 per kg.
  • Excessive variance from declared weights may result in offloading.
  • No refund is applicable if boarding is denied due to wrong weight declarations.

3. Flight Operations, Delays & Weather Conditions

Himalayan weather is highly unpredictable. The safety of our passengers and flight crew is our highest operational priority. Flights are strictly subject to weather clarity, visibility parameters, air traffic control (ATC) clearances, and technical safety approvals.

In case of flight delays, cancellations, or disruptions caused by bad weather, technical issues, or VIP movements, Ascend Luxee Aviation will make alternative arrangements or reschedule the flight subject to availability. Keeping at least one or two buffer days in your travel itinerary is highly recommended.

4. Structured Cancellation & Refund Matrix

Because helicopter charters require advanced slots, fuel sorting, and complex logistical coordination, cancellations attract structured retention fees as defined below:

Standard Cancellation Timeline
  • More than 20 Days before departure: 30% retention fee of the total package value.
  • Between 14 to 20 Days before departure: 50% retention fee of the total package value.
  • Within 14 Days of departure: 100% cancellation fee; no refunds will be provided.
  • Administrative Charge: A flat 5% administrative processing fee applies instantly upon confirmation.
Weather & Force Majeure Refunds
If a flight is completely cancelled by Ascend Luxee Aviation due to bad weather, technical groundings, or government restrictions, a pro-rata refund will be processed after deducting actual operational costs, ground transportation expenses, and resort handling charges incurred up to that point.

5. Passenger Conduct & Medical Eligibility

The Kedarnath and Badrinath sectors are located at very high altitudes, which can cause health complications like breathlessness or low oxygen levels for people with underlying medical conditions. Passengers must be medically fit for high-altitude travel.

Passengers must behave respectfully toward the flight crew, ground handlers, and co-passengers. Ascend Luxee Aviation reserves the absolute right to deny boarding to any individual who is intoxicated, uncooperative, medically unfit, or poses a safety risk to the aircraft.

6. Baggage Limits & Valuables Liability

  • Strict Weight Cap: A maximum of 2 kg of baggage is allowed per passenger. Oversized suitcases or heavy bags are strictly prohibited inside the helicopter cabin.
  • Restricted Items: Dangerous goods, flammables, weapons, and compressed gases are legally banned on board.
  • Valuables Disclaimer: Passengers are solely responsible for their personal belongings, cash, electronics, and jewelry. The company assumes no liability for lost or damaged luggage.

7. Governing Law & Dispute Resolution

This agreement, along with all booking services, operations, and passenger contracts, is governed by and construed in accordance with the statutory laws of India. Any legal disputes, claims, or conflicts arising from our services will fall under the exclusive jurisdiction of the competent courts in Dehradun, Uttarakhand, India.
